General sales conditions
Preamble
This site is the exclusive property of EFX sarl, as well as the related rights. Any reproduction partial or whole requires the authorization of it's owners. However, rights regarding links to this site may be authorized without request. 1. Acceptance of Conditions The Client has officially accepted the terms and conditions of EFX sarl from the moment an order has been placed.These conditions are presented to the client on their computer screen and must be entirely agreed upon before an order is placed. This action represents a contractual agreement between EFX sarl and their client. These Sales conditions apply to all cases except where special dispensation is requested in writing. 2. Products Rights regarding the photographs used to illustrate products do not fall under the terms of this contract. If any errors are made concerning the above, EFX sarl assume no liability. The majority of products offered by EFX sarl are available and kept in stock in their warehouse. 3. Orders An order placed by using the automatic recording system is considered as proof of purchase and of acknowledgement of it's content. An order can not be processed until a confirmation of the order is sent to the client. EFX sarl resserves the right to cancel any order if the client has outstanding debts from previous orders. If an order is sent to the wrong address due to an error in the information given to EFX sarl by the client, EFX sarl cannot be held responsible nor liable. 4. Delivery After confirmation of an order is made, EFX sarl must pass this information on to its dispatchers/transporters no longer than within a 48 hour period. The transporters are engaged by contract to deliver products to the address furnished by EFX sarl. In the case of a counter-reimbursement delivery the client is required to pay the entire sum up front upon receiving the goods. For deliveries made outside of France the purchaser of goods must pay any supplementary charges including Taxes, Value added taxes and Duties to the country where the goods are being delivered. Orders placed with EFX sarl are designated for personal use by its clients. Clients are strictly prohibited by law from the reselling of goods either is part or in whole. EFX sarl do not assume any legal responsiblity where Taxes / Duties are unpaid by the client. Deliveries will be carried out by La Poste in France. Any delays in delivery do not give the purchaser the right to file for dammages. For deliveries within the EEC and for countries outside of the EEC deliveries are made by Federal Express. In the case of war, catastrophes of nature, strikes and accidents the deliverer of goods cannot be held resposible. Packages must always be confirmed upon acceptance by the purchaser. Clients have a 48 hour period to notify the courier company and return goods if dammages occured in transit. If a client is unavailable to accept delivery several attempts will be made to make the delivery. However, fees corresponding to the number of attempted deliveries must be paid by the purchaser. If a client wishes a delivery to be made to more than one destination he must place 2 separate orders but the accompanying taxes will be linked as if in one order. 5. Exchange/Return Policy In case of an exchange, send back the product/s with their original packaging and include all accompanying paperwork to the following address : EFX sarl 15-19 rue de Louvain 92400 Courbevoie FRANCE 6. Prices The price for goods is expressed in Euros. The prices indicated for goods does not include shipping costs. The price found on the Order Confirmation docket is the definitive price including all Taxes and Value added tax for France and the other Countries of the European Community. This price also includes all shipping and handling charges. 7. Payment The price quoted on the Client's invoice (order confirmation docket) is the price he is expected to pay to EFX sarl. These fees are dues from the day the order/s are placed. Payments can be made by CB, Visa, Mastercard, American Express. Secure payments can also be made on-line by using the software cryptage SSL which enables the user to give credit card details directly to the bank La Societe Generale. The credit number never passes through the EFX sarl server guaranteeing a high level of security. An order placed in any ot the above manners can not be confirmed until the bank gives its authority. If a payment is declined by the bank, the order will automatically be cancelled and the client will be notified by email. EFX sarl reserves the right to refuse any orders with clients to whom are in legal contention. 8. Litigation The present contract is valid under French law and authority. EFX sarl cannot be held for dammages of any nature whereby resulting in commercial misuse of products. EFX sarl also may not be held libel if errors of manufacturing occur.Therfore, EFX sarl are not liable where any errors or omissions occur despite precaution taken in the presentation of products. In case of difficulties relating to the terms of the contract the purchaser may contest these difficulties by seeking legal aid or the aid of a consumer association or any other legal advice of their choice. It is noted that research into an amicable solution will not affect the time limit of the legal guarantee or the duration of the contractual guarantee. It is also noted that the general ruling is reserved under the rights of the court. The respect of measures of the present contract assume that the buyer accepts his financial resposibility towards EFX sarl. Any complaints or disputes will be given favourable consideration. Good faith will be given to those who seek to expose these situations. In the case of a lawsuit, the client will be given priority by the company in order to find an amicable solution. By default, The Court will rule over the case if such an amicable solution cannot be agreed upon. 9. Guarantee EFX sarl guarantees that all products are made and or published in France. The client may benefit from the legal eviction guarantee of latent defect (article 1625 of the civil code). If the buyer finds that a product are defective the seller must by law repair / replace the product (article 1641 of the civil code). If the client is to take the seller to court he must do so within a short time from when he discovers that the goods are defective (article 1648 of the civil code). Legal Information The informations furnished through the automatic on-line ordering system is obligatory to validate an order. It also validates the customer's guarantee. If false information is furnished by the client the order is invalid. This conforms to the law of "Information Technology and Liberty". The treatment of collective information relative to clients was the object of the declaration following the National Commission of Information Technology and Liberties (CNIL). The client has at his disposal (article 34 of the law of 6 January 1978) the right to access, to modify and to deny information concerning his personal information or concerning information given to EFX sarl. Following this, EFX sarl strictly agrees not to enclose information regarding its clients to competitors neither in part nor in whole. |
